Welcome to CropCart Markets. These Terms of Service ("Terms") govern your use of our website located at cropcartmarkets.com (the "Service") operated by CropCart Markets ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Platform Purpose

CropCart Markets is a directory and discovery platform designed to help users find farmers markets and local vendors across the United States. Our Service provides:

• A searchable directory of farmers markets
• Information about market locations, hours, and features
• Profiles of featured vendors
• Articles and resources about farmers markets

Important: CropCart Markets is a discovery platform, not a marketplace. We do not facilitate transactions between users and vendors. We do not sell products, process orders, or handle payments for goods sold at farmers markets. Any purchases you make at a farmers market are transactions between you and the vendor or market operator.

User Responsibilities

By using our Service, you agree to:

• Provide accurate and complete information when submitting forms or applications
• Use the Service only for lawful purposes and in accordance with these Terms
• Not attempt to gain unauthorized access to any part of the Service
• Not use the Service to transmit spam, viruses, or malicious code
• Not scrape, copy, or reproduce our content without permission
• Respect the intellectual property rights of CropCart Markets and third parties

Market and Vendor Listing Disclaimers

While we strive to provide accurate and up-to-date information, we make no guarantees regarding the accuracy, completeness, or reliability of market or vendor listings.

• Market Information: Hours, dates, and locations may change without notice. We recommend confirming details with the market directly before visiting.
• Vendor Availability: Featured vendors may not be present at every market session. Product availability and pricing are determined by vendors.
• Third-Party Content: Information about markets and vendors may be provided by third parties or publicly available sources. We do not verify all claims.
• No Endorsement: Listing a market or vendor on our platform does not constitute an endorsement of their products, services, or business practices.

Verified Vendor Program

Our Verified Vendor program allows vendors to apply for enhanced visibility on CropCart Markets and receive a physical Verified Vendor kit. By applying to the program, vendors agree to the following:

• Application Review: We reserve the right to approve or deny any application at our sole discretion.
• No Guarantee of Results: Participation in the Verified Vendor program does not guarantee increased sales, customers, or any specific business outcomes.
• Accurate Information: Vendors must provide accurate information about their business, products, and market presence.
• Content Rights: By submitting content (photos, descriptions, etc.), vendors grant us permission to use this content on our platform and marketing materials.
• Physical Kit: The Verified Vendor kit is included with your first year membership and shipped to the address provided. We are not responsible for lost or delayed shipments.
• Annual Membership: The Verified Vendor program is an annual membership. First year is $199 (includes kit), then $99/year to maintain your Verified status.
• Renewal: Membership renews annually at $99/year. You may cancel anytime before your renewal date.
• Refund Policy: The first year application fee is refundable only if your application is not approved. Approved vendors are not eligible for refunds.

Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of CropCart Markets. Our trademarks, trade names, and trade dress may not be used without our prior written consent.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without our express written permission.

User Submissions

When you submit content to our Service (such as market submissions, vendor applications, or contact form messages), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, publish, and display that content in connection with our Service.

You represent and warrant that you own or have the necessary rights to submit content and that your content does not infringe on any third party's rights.

Limitation of Liability

To the maximum extent permitted by law, CropCart Markets shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage resulting from visiting a farmers market
• Any issues arising from transactions with vendors or market operators
• Inaccurate or outdated information in market or vendor listings
• Service interruptions, errors, or technical issues

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The information provided will be accurate, complete, or current
• Any defects or errors will be corrected
• The Service will meet your specific requirements or expectations

Indemnification

You agree to defend, indemnify, and hold harmless CropCart Markets, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

Third-Party Links

Our Service may contain links to third-party websites or services that are not owned or controlled by CropCart Markets. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such websites or services.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
